MD of Pincher Creek planning commission to research rural development setbacks

Christian Davis

At their January 6, 2016 meeting council for the MD of Pincher Creek No. 9 unanimously agreed to a recommendation from Director of Development and Community Services Roland Milligan regarding development setback research. According to Milligan's report, at the January 5, 2016 meeting of the Municipal Planning Commission (MPC) a resolution was passed that he recommend to council a survey of several other southern Alberta municipalities "to research their setbacks for development permits, and the reasons for these specific setbacks; And that this information be returned to the Municipal Planning Commission for future discussions regarding setbacks on rural developments."

"The researched information may be considered to determine if the existing development setbacks are adequate or if amendments are required."

As background for the initiative Milligan's report cited Section 639 of the Municipal Government Act, Revised Statutes of Alberta, 2000, Chapter M-26, as amended, which states that council "must pass a Land Use Bylaw." The current Land Use Bylaw 1140-08 became effective March 11, 2008, "which the Municipal Planning Commission uses to render its decisions".
